(SL III)
03/16/2015 On March 16, 2015, the NRC issued a Notice of Violation, characterized as a Severity Level III Problem to Entergy Nuclear Operations, Inc. (Entergy) for a violation of 10 CFR 50.9, "Completeness and accuracy of information," and 10 CFR 55.3, "License requirements."  This violation involved the failure to provide information to the Commission that was complete and accurate in all material respects and the failure to notify the NRC of a change in a licensed operator's medical condition.  Specifically, Entergy submitted an NRC licensed operator renewal application that certified the medical fitness of an applicant.  This information was inaccurate in that the applicant had a medical condition that did not meet the minimum standards of 10 CFR 55.33(a)(1), that required a restricting license condition to use a therapeutic device.  Entergy also did not report this change in a permanent medical condition to the NRC within 30 days nor did Entergy request an amended license with a condition to account for the medical issue.

04/29/2014 On April 29, 2014, the NRC issued a Severity Level III (SL III) Notice of Violation to Entergy Nuclear Operations, Inc. for a violation identified as a result of an investigation by the NRC Office of Investigations. This violation involves the former Chemistry Manager at Indian Point Energy Center deliberately entering false data into a Chemistry database pertaining to an Emergency Diesel Generator fuel oil storage tank and the reserve fuel oil storage tank.  The falsification of records caused Indian Point to operate Units 2 and 3 in violation of technical specifications (TS) and to avert a dual-unit shut-down required by TS 3.03.  Additionally, a SL III NOV and an order were issued banning the former IP Chemistry Manager from participating in NRC activities for a period of one year for violating Title 10 of the CFR 50.5.

01/24/2008 On January 24, 2008, a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $650,000 was issued to Entergy Nuclear Operations, Inc. This action was based on a continuing SL III violation of the NRC's January 31, 2006, Confirmatory Order to implement Section 651(b) of the Energy Policy Act (Act) of 2005. The Order required Entergy to install backup power for the Indian Point Alert and Notification System (ANS) by January 31, 2007. The NRC subsequently extended, at the licensee's request, the implementation date to April 15, 2007. On April 23, 2007, the staff issued a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $130,000 when Entergy failed to meet the April 15, 2007, implementation date. On July 30, 2007, the NRC issued an Order to supplement the requirements of the January 31, 2006, Confirmatory Order, based on Entergy's proposed corrective actions for noncompliance with the Confirmatory Order. On August 30, 2007, the staff issued a subsequent Notice of Violation for Entergy's failure to place the new ANS in service by August 24, 2007, as required by the July 30, 2007, Order. As of April 16, 2007, the licensee remains in violation of the Orders.

NOV(SL-TBD) 08/30/2007 On August 30, 2007, a Notice of Violation was issued for failure to meet the conditions of a July 30, 2007, Order which required the licensee to implement an Emergency Notification System (ENS) with backup power capability by August 24, 2007. Specifically, the licensee failed to obtain necessary approvals so that the new ENS system could be placed in service as the primary notification system by August 24, 2007. The NRC will determine the severity level, any civil penalty, and any required responses from Entergy regarding this matter at a later time.
EA-07-189
Indian Point 2 & 3
ORDER 07/30/2007 On July 30, 2007, an Immediately Effective Order was issued to Entergy Nuclear Operations, Inc., to ensure compliance with the regulations and implementation of the requirements of the Energy Policy Act of 2005. The Order supplemented the requirements of NRC Confirmatory Order (EA-05-190) which required, in part, a backup power system for the Emergency Notification System (ENS). The Confirmatory Order was issued to the Indian Point Nuclear Generating Unit Nos. 2 and 3 on January 31, 2006, and was amended by the NRC on January 23, 2007, extending the implementation date for the required ENS backup power system to April 15, 2007. The requirements of the January 31, 2006, Confirmatory Order remain in effect except as specifically modified or supplemented by this Order.
