Public Involvement in the Proposed Security Rulemaking for Independent Spent Fuel Storage Installations
The U.S. Nuclear Regulatory Commission (NRC) has a long-standing practice of conducting its regulatory, licensing, and oversight activities in an open manner. For that reason, the NRC is committed to informing the public about its regulatory activities regarding the Proposed Security Rulemaking for Independent Spent Fuel Storage Installations (ISFSIs), and providing opportunities for the public to participate in the agency's decisionmaking process. The NRC's Office of Nuclear Security and Incident Response, Division of Security Policy, held a classified meeting to discuss information relevant to the proposed security rulemaking. This meeting was held in response to a stakeholder's request at the NRC's public meeting on May 2, 2011 (see below), in order to assist cleared stakeholders in understanding the purpose and direction of the proposed rulemaking and informing their comments on Draft Regulatory Guide DG-5033, "Security Performance (Adversary) Characteristics for Physical Security Programs for 10 CFR Part 72 Licensees."

Meeting participants discussed comments received as a result of the NRC's notice of availability of the draft technical (regulatory) basis for the proposed rulemaking, as well as the related solicitation of comments. Specifically, the staff presented six issues: design-basis threat versus dose calculation approach, dose limit implications, security plan reviews, license hearing implications, force-on-force assessments, and "enemy of the state" language in 10 CFR 73.55, "Requirements for Physical Protection of Licensed Activities in Nuclear Power Reactors against Radiological Sabotage."
The NRC also presented related ISFSI security study results from the 2003–2005 assessments and information on the proposed Draft Regulatory Guide DG-5033, "Security Performance (Adversary) Characteristics for Physical Security Programs for 10 CFR Part 72 Licensees." This portion of the meeting was closed because of the discussion of Safeguards Information.

The NRC hosted a public Webinar as a followup to its Notice of Availability and Solicitation of Public Comments on the draft technical (regulatory) basis for the proposed rulemaking, published in the Federal Register on December 16, 2009 (74 FR 66589). The purpose of this meeting was to discuss comments from the public, licensees, and other stakeholders and confirm the adequacy of the technical basis to proceed with the rulemaking to issue new risk-informed and performance-based security regulations for spent nuclear fuel and high-level waste storage facilities.
